California Attorney General Says Second Amendment Justifies Racist Law

California Attorney General Kamala Harris
California Attorney General Kamala Harris
How can you tell that California Attorney General Kamala Harris is losing her fight to uphold California's ban on openly carrying loaded and unloaded firearms in public?

When she asks the court to adopt her bizarre interpretation of the Second Amendment which is:

"the Founding Fathers championed the Second Amendment, which Nichols invokes as a weapon against allegedly racist laws, to try to legitimize Southern citizen “slave patrols” that terrorized enslaved African-Americans, and thereby to entice Southern states to support the U.S. Constitution....This Court should not overturn either the Second Amendment or what Nichols sees as its antagonist, Section 25850..."

In short, AG Harris is arguing that the Framers of the Second Amendment intended it to validate racially discriminatory gun laws and therefore overturning the 1967 California Loaded Open Carry ban would be overturning the Second Amendment.

Some folks have their knickers all in a twist because the US Supreme Court said that Open Carry is the right guaranteed by the Constitution and that concealed carry can be prohibited: "[A] right to carry arms openly: "This is the right guaranteed by the Constitution of the United States, and which is calculated to incite men to a manly and noble defence of themselves, if necessary, and of their country, without any tendency to secret advantages and unmanly assassinations."" District of Columbia v. Heller, 128 S. Ct. 2783 - Supreme Court (2008) at 2809. "Like most rights, the right secured by the Second Amendment is not unlimited. From Blackstone through the 19th-century cases, commentators and courts routinely explained that the right was not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose. For example, the majority of the 19th-century courts to consider the question held that prohibitions on carrying concealed weapons were lawful under the Second Amendment or state analogues." District of Columbia v. Heller, 128 S. Ct. 2783 - Supreme Court (2008) at 2816.

The "Law" or the "Bill of Rights" are of no relevance to the puppets in today's government. Or as the Messiah and his leader Soros has commanded them, play the race card at all times with all things.

Tim, Glenn Beck called--he wants you to give him back his stolen identity.

Ivan, I watch CNN, I enjoy the clueless comedy of the liberals.....

The United States is 3rd in the world in murders. However, if you take out Chicago, Detroit, New Orleans and Washington DC, the United States is fourth from the bottom in murders. All of these are Democratic cities with the toughest gun control laws in the United States. Democrats, bad for cities, bad for California, bad for America and bad for Redondo Beach. We need to vote out all Democratic Politicians, before they destroy this city too..........
Harry Frisby Jr December 28, 2013 at 12:44 AM
I am seriously considering running for District 3 when Pat Aust terms out. I am a constitutional libertarian that leans towards the tea party. I fully support the actions by Ted Cruz, Rand Paul and Marco Rubio. Please watch for my name for Redondo Beach City Council in the year to come. Also to note, I am a upper management employee who knows the workings of city government.. I am employed by a neighboring city agency and have also served on the RB Public Works Commission from 2007 to 2011.

No thanks, Harry.
Bruce Szeles December 28, 2013 at 05:36 PM
Harry - I hear you on your national views but the RB council deals with issues on a local level. What are you involved with at the local level other then your commission work? You live in North Redondo. How would you focus attention and activity on the area where you live? District 3 had a murder in July and the suspect has still not been caught. How would you address public safety issues? How would you help and promote the business district in North Redondo? You live in an area that has the most young families in the city. How would you improve the public amenities for young children and teens that are available in the south end of town but not in the north? Where would you put the new transit station? Where would you put the new police station? What anchor store would you attract to the Galleria to replace Nordstrom? Thank you.

Harry, I would like to hear your answers to Bruce Szeles well thought out questions. I would also like to add a two more questions: How would you, at a local level, fight off over regulation from the state or county that kill small (mom and pop shops) business growth? Also to the point of this column, how would you stop further infringement of the second amendment at the local level?
Bruce Szeles January 08, 2014 at 03:04 PM
Well Tim. Looks like candidate Harry Frisby Jr. has not done his homework on local issues and plans to run on the one feather in his cap of being a city commissioner. These same commissioners are able to get appointed only if they tow the city managers agenda. As a council member they will be tasked to direct the actions of that same city manager. Guess who will wagging the dog?
